Judge to rule on motion to have appeal dismissed

New Albany Police Merit Commission attorneys argued Wednesday for the dismissal of an appeal by police officer and City Councilman Jack Messer over his suspension for conduct unbecoming an officer. Messer -- a 27-year New Albany Police Department veteran and at-large councilman -- was suspended without pay for 40 days last year by the merit commission. The discipline resulted primarily from comments Messer made during a police roll call meeting in January of 2010
