Residents upset as houses moved into former park

A group of New Albany residents in the area near Howard McLean Park are angry because houses have been moved to the park in a process they say is illegal. The houses, 23 in all, were recently moved to the land after most of them were relocated due to the expansion of Floyd Memorial Hospital...CHDO is in charge of the program that will repair the houses and sell them to first-time homebuyers.. Becky Gardenour, who lives on Captain Frank Road, said the houses were moved to the park illegally. Gardenour said the property does not belong to the city and should go to the heirs of the property. Local residents said the Fawcett family of New Albany gave the land to the city in 1935 to be used for recreational purposes and that the deed specifically states that if the land is used for any other purpose then it would have to be returned to the heirs of the Fawcett family. City Planning Director John Rosenbarger said the deed is not binding because in Indiana the covenant is not valid after 30 years.
